The Covid-19 crisis brought significant disruption and financial defaults in the business throughout the globe. From a procedural standpoint, the arbitration community and institutions swiftly adapted from the outset to ensure that ongoing cases continue to run as smoothly as possible. Yet the substantive consequences of the Covid-19 crisis are still to arise, and the arbitration stakeholders (arbitrators, counsel and parties) need to be ready to face them. We will address the questions that are likely to be raised before arbitral tribunals in the context and their likely outcome under English, French and German laws, and draw some practical advice as to the conduct of the parties and the drafting of the clauses to cover such events.
