The Covid-19 crisis brought significant disruption and financial defaults in the business throughout the globe. From a procedural standpoint, the arbitration community and institutions swiftly adapted from the outset to ensure that ongoing cases continue to run as smoothly as possible. Yet the substantive consequences of the Covid-19 crisis are still to arise, and the arbitration stakeholders (arbitrators, counsel and parties) need to be ready to face them. We will address the questions that are likely to be raised before arbitral tribunals in the context and their likely outcome under English, French and German laws, and draw some practical advice as to the conduct of the parties and the drafting of the clauses to cover such events.
We will notably try to answer the following questions:
- How will tribunals assess force majeure, hardship or analyse MAC clauses in this specific context?
- What can be done to anticipate the consequences of such events in future disputes?
The speakers will be:
- Mr. Toby Laudau QC, barrister, advocate and arbitrator at Essex Court Chambers (London) and Essex Court Chambers Duxton (Singapore), member of the Bars of England & Wales, Singapore, New York, the BVI and Northern Ireland, and registered in the DIFC;
