Due diligence in the agricultural sector

In 2024, the Austrian National Contact Point for the OECD Guidelines for Multinational Enterprises on Responsible Business Conduct (öNKP) will focus on the recent Update of the Guidelines. The fourth webinar in the series focuses on due diligence in the agricultural sector and their implementation in business activities.

Human rights and environmental due diligence are becoming increasingly important for companies. This is reflected in current legal initiatives at national (Germany, France, Netherlands) and European level (Corporate Sustainability Due Diligence and amending Directive). The OECD Guidelines for Multinational Enterprises, which were updated in June 2023, also emphasize the responsibility of companies to comply with and implement standards in environmental and climate protection, biodiversity protection, human rights and other aspects. In addition, the OECD, together with the FAO, addressed the agricultural sector in particular in its guidance for responsible agricultural supply chains.

Internationally agreed principles on responsible business conduct are intended to ensure that companies make a sustainable contribution. According to the principles, companies should analyze their value chain in order to avoid negative impacts on the environment and society and, if necessary, take measures in this regard. Companies should comply with standards to establish responsible agricultural supply chains. Among other things, companies should ensure that their business activities are in line with internationally adopted and scientifically based climate and environmental goals. Companies are also required to define their own environmental and climate protection targets.

On January 31, 2024, the Austrian National Contact Point for the OECD Guidelines will hold a webinar on how companies are dealing with the increasing requirements for due diligence in the agricultural sector and the challenges this poses. Experts will report on their experiences and discuss approaches on how economic actors can effectively implement due diligence obligations along their value chain and in their core business.

General Questions:

• How do international legal frameworks (binding and non-binding) influence the handling of due diligence obligations (e.g. updated OECD Guidelines, CSDDD, UN Guiding Principles, etc.)?
• What challenges do companies face when implementing due diligence obligations in the agricultural sector?
• What methods and tools do companies use to implement due diligence as mentioned in the OECD-LS?
• How is it possible to avoid and/or compensate for potential negative effects of the agricultural sector (social or environmental) in advance through corporate activities and what needs to be taken into account in this regard?

Umsetzung von Sorgfaltspflichten im Agrarsektor

Im Jahr 2024 befasst sich der österreichische Nationale Kontaktpunkt für die OECD-Leitsätze für multinationale Unternehmen (öNKP) schwerpunktmäßig mit der Aktualisierung der Leitsätze rund um das Thema unternehmerische Sorgfaltspflichten. Das vierte Webinar der Serie legt den Fokus auf Sorgfaltspflichten im Agrarsektor und deren Umsetzung bei wirtschaftlichen Aktivitäten.

Menschenrechtliche und umweltbezogene Sorgfaltsprüfungen gewinnen für wirtschaftliche Akteure zunehmend an Bedeutung. Dies spiegelt sich insbesondere in aktuellen gesetzlichen Vorstößen auf nationaler (Deutschland, Frankreich, Niederlande) und europäischer Ebene (Corporate Sustainability Due Diligence and amending Directive) wider. Auch die im Juni 2023 aktualisierten OECD-Leitsätze für multinationale Unternehmen betonen die Verantwortung von Unternehmen bei der Einhaltung und Umsetzung von Standards im Umwelt- und Klimaschutz, Schutz der Biodiversität sowie bei menschenrechtlichen und weiteren Aspekten. Darüber hinaus adressierte die OECD zusammen mit der FAO den Agrarsektor im speziellen in ihrem Leitfaden für verantwortungsvolle landwirtschaftliche Lieferketten.

International vereinbarte Grundsätze zu verantwortungsvollem unternehmerischem Handeln sollen sicherstellen, dass Unternehmen einen nachhaltigen Beitrag leisten. Laut den Leitsätzen sollen Unternehmen ihre Wertschöpfungskette analysieren, um negative Auswirkungen auf Umwelt und Gesellschaft zu vermeiden und wenn notwendig diesbezüglich Maßnahmen setzen. Unternehmen sollen Standards einhalten, um verantwortungsvolle landwirtschaftliche Lieferketten aufzubauen. Unter anderem sollen Unternehmen sicherstellen, dass ihre unternehmerische Tätigkeit im Einklang mit international verabschiedeten und wissenschaftlich fundierten Klima- und Umweltzielen ist. Unternehmen sind zudem angehalten, eigene Ziele im Bereich Umwelt- und Klimaschutz zu definieren.

Am 31. Jänner 2024 informiert der österreichische Nationale Kontaktpunkt für die OECD-Leitsätze in einem Webinar darüber, wie Unternehmen mit den steigenden Anforderungen an Sorgfaltspflichten Agrarsektor umgehen und welche Herausforderungen dadurch entstehen. Experten berichten von ihren Erfahrungen und erörtern Vorgehensweisen, wie wirtschaftliche Akteure Sorgfaltspflichten entlang ihrer Wertschöpfungskette und im Kerngeschäft effektiv umsetzen können.

Fragestellungen:

• Wie beeinflussen internationale, rechtliche Rahmenwerke (bindend und nicht-bindend) den Umgang mit Sorgfaltspflichten (z.B. aktualisierte OECD-Leitsätze, CSDDD, UN Guiding Principles, etc.)?
• Vor welchen Herausforderungen stehen Unternehmen bei der Umsetzung von Sorgfaltspflichten im Agrarsektor?
• Welche Methoden und Tools wenden Unternehmen an, um Sorgfaltspflichten, wie in den OECD-LS genannt, zu implementieren?
• Wie wird es möglich, durch Unternehmensaktivitäten potentielle negative Effekte des Agrarsektors (soziale oder umweltspezifische) vorab zu vermeiden und/oder zu kompensieren und was ist dabei zu beachten?
